(1) The following Special Police Courts shall be constituted in relation to the following ranks of police personnel for the initiation and disposition of cases relating to offenses punishable under this paragraph:-
(a) District Police Special Court for Police Constables to Sub-Inspectors of Police,
(b) Regional Police Special Courts for Deputy Inspectors of Police to Deputy Superintendents of Police,
(c) Central Police Special Court for Superintendent of Police and above police officers.
(2) According to subsection (1), the District Police Special Court, the Regional Police Special Court and the Central Police Special Court will be established by the Ministry of Home Affairs of the Government of Nepal as per the need and each court will have three members including one police officer under the chairmanship of the justice service officer and the person to be prosecuted shall be a police officer. If so, the officer lower than him will not be in the special court.
